Adaptiv Privacy Policy

Adaptiv, Inc. (“Adaptiv,” “we,” or “us”) understands the importance of safeguarding the privacy and security of the personal information of website visitors at www.getadaptiv.com (the “Site”). This Privacy Policy outlines the types of personal information that we collect, use, and disclose through the Site. For this Privacy Policy, “personal information” refers to any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual or, where applicable, a household.

This Privacy Policy applies to the personal information collected on the Site and personal information acquired about our Customers (as defined below). It does not apply to personal information obtained offline or through channels other than the Site or in connection with the provision of our Services (as defined below).

 

I. INFORMATION COLLECTION HOW WE GATHER PERSONAL INFORMATION: 

The personal information we collect depends on the interaction between you and Adaptiv, which can be broadly classified into the following:

 

Using Adaptiv Software as a Service. Suppose you use Adaptiv Software as a Service (the “Services”). In that case, we save all of the content you provide, including but not limited to team member accounts, files, images, project information, and any other information you submit to the Services.

 

We also gather data on the use of the Services, such as user and flow numbers, broadcasts, and so on.

Using the Site: If you use the Site, we collect specific information, as described below in greater detail, that may, on its own or in combination with other data, qualify as personal information.

 

Personal Information Types:

 

(i) Adaptiv Customers (“Customers”): Name, address, company name, identification, publicly available social media profile information, email, IT information (IP addresses, usage data, cookie data, browser data), and financial information (credit card details, account details, payment information). We engage third-party service providers to handle your credit card transactions, and they are bound by their own agreements.

 

(ii) Subscription Purchases. If you purchase a Subscription for the Services, we collect information to process your payment and establish your customer account. This information includes your name, email address, physical address, telephone number, and company name (where applicable). We retain the last four digits of your credit card number to facilitate identification of the card used for future purchases. We engage third-party service providers to manage your credit card transactions, and they are bound by their own agreements.

 

(iii) Customer-Generated Content. Our products and services often offer the option to provide feedback, such as suggestions, compliments, or encountered problems. We encourage you to give such feedback and participate in comments on our blog and community page. If you comment, your username, city, and any other information you provide will be visible to the public. We do not guarantee the privacy of any information that you post on the Site, including in our blogs, or the accuracy of any content in such postings. Disclosed information becomes public information, and we cannot prevent its misuse in a manner that violates this Privacy Policy, the law, or your personal privacy.

 

(iv) Information gathered for and by our Clientele. You may import into our system personal information you have obtained from your users, customers, potential customers, and social media and messaging platform connections (collectively “Subscribers”) or other persons when you use our Services. We have no direct contact with your Subscribers or any other individual, thus it is your responsibility to ensure that we have the appropriate permission and legal basis to collect and handle information about such persons. We may use the information you have supplied, received from you, or obtained about Subscribers as part of our Services. To learn more about how we use Subscribers’ personal information, please refer to our Privacy Statement.

 

(v) Information automatically gathered. Our systems may automatically record some information about your usage of our Site (which we refer to as “Log Data”), including information about both Customers and casual visitors. Log Data may comprise a user’s Internet Protocol (IP) address, device and browser type, operating system, the pages or features of our Site that a user visited and the time spent on those sites or features, the frequency with which a user uses the Site, search words, and other data. When you use our Services, Adaptiv and our partners may utilize different technologies to collect and store information, including the use of cookies and similar tracking technologies on our Site, such as pixels and web beacons. Individual web browsers allow users to modify cookie settings. Alone or in combination with other information, log files and cookie-collected information may constitute personal information.

 

(vi) Sensitive personal information. Please refrain from sending or disclosing any sensitive personal information (such as social security numbers, data related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic traits, criminal background, or union membership) to us via the Services or otherwise.

 

Suppose you choose to provide or disclose sensitive personal information to us. In that case, you must agree to our processing and use of such sensitive personal information in line with this Privacy Statement. You must not supply such sensitive personal information if you do not consent to our processing and use of it. In the section under “Your Data Protection Rights and Options,” you may use your data protection rights to object to or restrict the processing of this sensitive personal information, or to request that it be deleted.

 

II. REASONS FOR COLLECTING DATA

For service operations I to operate, maintain, administer, and improve the Services; (ii) to manage and communicate with you regarding your Services account, if you have one, including by sending you Services announcements, technical notices, updates, security alerts, and support and administrative messages; (iii) to process payments you make through the Services; (iv) to better understand your needs and interests, and personalize your experience with the Services; and (v) to send you marketing communications relating to the Services.

 

To correspond with you. If you request information from us, register for our Services, or participate in our surveys, contests, or events, we may send you marketing materials relevant to Adaptiv if authorized by law, but you can opt out.

 

Administration and analysis: We use automatically-collected information to administer the Service and the Site, and we analyze (and may engage third parties to analyze) this information to improve and enhance the Site and the Services by extending their features and functionality and customizing it according to our Users’ needs and preferences.

 

To analyze trends, administer the Site, monitor users’ movements throughout the Site, offer targeted ads, and collect demographic information about our user base as a whole.

 

To abide by the law. We use your personal information to comply with relevant laws, authorized demands, and legal process, such as responding to subpoenas or requests from government agencies.

 

With your permission. We may use or disclose your personal information with your consent, such as when you permit us to post your testimonials or endorsements on our website, when you instruct us to take a specific action with respect to your personal information, or when you opt-in to receive marketing communications from third parties.

 

To anonymize data for use in analytics. We may de-identify your personal data. We de-identify personal information by removing information that makes the data personally identifiable to you, and we utilize the de-identified data for our legitimate business reasons.

 

For compliance, prevention of fraud, and safety. We use your personal information as we deem necessary or appropriate to (a) enforce the terms and conditions governing the Services; (b) protect our rights, privacy, safety or property, and/or that of you or others; and (c) protect, investigate, and deter fraudulent, harmful, unauthorized, unethical or illegal activity.

 

To supply, maintain, and enhance the Services we provide. This includes our use of the data that our Customers send us to allow our Customers to communicate with Subscribers through the Services. This includes, for example, aggregating information from your usage of the Services or visit to our Site and sharing it with third parties in order to enhance our Services. This may also involve exchanging your information or the information you supply about your Subscribers with third parties in order to offer and maintain our Services or to make certain Services features accessible to you. When we must disclose personal information with third parties, we secure your information by asking these third parties to sign a contract requiring them to use the personal information we send to them for authorized business reasons and in a way consistent with this Privacy Policy.



IV. SHARING OF YOUR PERSONAL INFORMATION

We do not disclose or sell your personal information to other parties without your explicit permission, except as this Privacy Statement notes. In the following conditions, we release personal information to third parties:

 

Service Suppliers We may use third-party firms and people to administer and offer the Services (such as bill and credit card payment processing, customer support, hosting, email delivery and database management services). These third parties may use personal information about you solely to execute these activities for authorized business objectives in line with the terms of the agreement(s) we have with these service providers, and for no other purpose.

 

Professional Consultants. We may share your personal information with our professional advisers, such as attorneys, bankers, auditors, and insurers, where appropriate in the course of the professional services they provide for us.

 

Business Transfers. When our company grows, we may sell or acquire companies or assets. Personal information may be among the transferred assets in the case of a corporation sale, merger, reorganization, dissolution, or similar event. You agree that any successor or purchaser of Adaptiv (or its assets) will continue to have the right to use your personal information and other information in accordance with the provisions of this Privacy Policy. Moreover, Adaptiv may release aggregated personal information to potential acquirers or business partners in order to represent our Services.

 

Compliance with Laws and Enforcement of Law; Safety and Protection. Adaptiv may disclose information about you to government or law enforcement officials or private parties as required by law, and disclose and use such information as we believe necessary or appropriate to (a) comply with applicable laws and lawful requests and legal process, such as to respond to subpoenas or requests from government authorities; (b) enforce the terms and conditions that govern the Services; (d) protect our rights, privacy, safety or property, and/or the rights, privacy, safety or property of others; and/or (e)

 

YOUR INFORMATION PROTECTION RIGHTS AND OPTIONS

You possess the following privileges:

 

You may see the personal information Adaptiv collects about you at any time by contacting us using the information given under the “How to Contact Us” column.

By signing into their account, Adaptiv account holders may check, update, rectify, or remove the personal information in their registration profile. Customers with a Adaptiv account may also contact us if they have any extra requests or inquiries.

 

Suppose you are a resident of the European Economic Area (“EEA”). In that case, you may object to the processing of your personal information, ask us to limit the processing of your personal information, or, if technically feasible, seek the portability of your personal information. Again, you may exercise these rights by contacting us through the means provided below.

Similarly, if we have acquired and processed your personal information with your permission and you are an EEA resident, you may withdraw your consent at any time. Your withdrawal of permission will not impact the legality of any processing we undertook previous to your withdrawal, nor will it affect the processing of your personal information undertaken based on valid processing grounds other than consent.

You may file a complaint with a data protection authority over the acquisition and use of your personal information by our organization.

 

Consumers Control Access to Their Data. Adaptiv does not have a direct connection with the persons whose personal information is included in the Custom User Fields handled by our Service. A person who requests access, or who wishes to edit, update, or delete personal information submitted by our users, should address their request directly to the Customer.

 

V. RETENTION OF INFORMATION

We shall store the personal information we process on behalf of our Customers for as long as necessary to deliver our Services, or indefinitely if necessary to comply with our legal duties, settle disputes, prevent abuse, and enforce our agreements. If compelled by law, we shall remove personally identifiable information from our database.




VI. DATA TRANSFERS

Your personal data may be kept and processed in any country in which we have facilities or contract service partners. By accepting the terms of this Privacy Statement, you acknowledge, agree, and consent to (1) the transfer to and processing of personal information on servers located outside the country in which you reside and (2) our collection and use of your personal information as described herein and in accordance with the data protection laws of the countries in which we have facilities or engage service providers, which may be different and may be less protective than those of your country of residence.

 

VII.INFORMATION ABOUT CHILDREN

We feel it is essential to give further internet safety for youngsters. We urge parents and guardians to spend time online with their children in order to watch, participate, and/or guide their online activities. Adaptiv does not intentionally collect or solicit personal information from children under 16. You may not register for the Services or submit us any information about yourself, including your name, address, telephone number, or email address, if you are under 16 years of age. If we determine that we have obtained personally identifiable information from a child under the age of 16 without verification of parental permission, we will immediately delete the information. Please contact us if you are the parent or legal guardian of a child under 16 and think we may have information from or about your child.

 

VIII. SECURITY

Notification of Security Breach

 

If a security breach results in an unauthorized penetration into our system that seriously impacts you or your Subscribers, Adaptiv will tell you as quickly as feasible and detail the actions we did in response.

 

Protecting Your Information

 

We take reasonable and adequate precautions to safeguard personal information against loss, misuse, unauthorized access, disclosure, modification, and destruction, considering the processing risks and the sensitivity of the information. Despite our efforts to store personal information collected on and through the Site and/or the Services and otherwise by us in a secure operating environment that is not accessible to the public, we cannot guarantee the security of personal information during transmission or while it is stored on our systems. In addition, although we strive to protect the integrity and security of personal information, we cannot guarantee that our security measures will prevent unauthorized access to personal information by third parties such as so-called hackers. We do not promise or imply that your personal information will be safeguarded against third-party loss, abuse, or modification.

 

Our payment card processing operator employs security measures to safeguard your information both during and after the transaction. LEGAL BASIS FOR PROCESSING YOUR PERSONAL INFORMATION (EEA VISITORS/CUSTOMERS ONLY)

Suppose you are a resident of the European Economic Area. In that case, the legal basis for our collection and use of the above-described personal information will depend on the individual personal information and the circumstances in which we gather it. We will typically only collect personal information from you when we have your permission, when we require the information to complete a contract with you, or when it is in our legitimate business interests to do so. In certain instances, law may require us to gather your personal information.

 

Whenever we request personal information in order to comply with a legal obligation or to enter into a contract with you, we will make this apparent at the time and indicate whether the giving of such information is required or not (as well as of the possible consequences if you do not provide your personal information). Similarly, if we collect and use your personal information based on our legitimate business interests, we will tell you at the time of collection or use of such interests.

Modifications to our privacy policy

This Privacy Statement will be modified as necessary in response to any legal, technological, or commercial changes. When we amend our Privacy Policy, we will take steps commensurate with the gravity of the changes to tell you. Where and where needed by relevant data protection legislation, we will request your approval prior to implementing major changes to our Privacy Statement.

 

Check the “Last Updated” date listed at the top of this Privacy Policy to see when the most recent revision was made. The new Privacy Policy will supersede any earlier notifications that are inconsistent with it and will apply to all current and former website users.
